Lien Search in Lumpkin County, GA: Liens and Judgments on Title

The short answer

A lien search in Lumpkin County, GA starts with the GSCCCA lien index, which covers liens filed since at least January 1, 2004, and the Clerk of Superior Court, which records deeds, liens, plats and state tax executions. Here is where each kind of lien is filed, the Georgia deadlines that make some expire, and how security deeds, judgments, tax and association liens show up on title.

A lien search in Lumpkin County, GA covers two places: the GSCCCA lien index online, which covers liens filed in all Georgia counties since at least January 1, 2004 (GSCCCA), and the Lumpkin County Clerk of Superior Court, which files, indexes and permanently records deeds, mortgages, liens, plats and state tax executions (O.C.G.A. § 44-2-2). Records older than the online coverage are searched in the Clerk’s books. Security deeds, Georgia’s version of a mortgage, are recorded instruments too, so a complete search covers the deed records as well as the lien index.

Where each lien is recorded, and the Georgia rule

Lien or claim Where to look The Georgia rule
Security deed (loan) Clerk of Superior Court real estate records; GSCCCA deed index Passes title to the lender until paid (O.C.G.A. § 44-14-60); cancellation due within 60 days of full payment (O.C.G.A. § 44-14-3)
Judgment The general execution docket No lien against good-faith buyers until the execution is entered on the execution docket (O.C.G.A. § 9-12-81); dormant after seven years without the required entries (O.C.G.A. § 9-12-60)
Mechanic’s or materialman’s lien Claim of lien filed with the Clerk; GSCCCA lien index File within 90 days after the work is completed; lien action within 365 days of filing (O.C.G.A. § 44-14-361.1)
County property tax fi.fa. Recorded in the Clerk’s office Recorded when taxes stay unpaid more than 90 days after the due date (Lumpkin Tax Commissioner)
State tax execution Clerk of Superior Court Ten years from recording to collect, subject to statutory extensions; may not be renewed (Georgia DOR)
Federal tax lien Lien dockets, which hold liens filed under state or federal law Released within 30 days after the tax debt is paid (IRS)
Property owners’ association assessment Ask the association and the closing attorney A lien superior to other liens except those the statute lists; lapses four years after the assessment first became due (O.C.G.A. § 44-3-232)
Lis pendens (pending lawsuit) Notice filed with the Clerk where the land lies No lis pendens until the notice is filed (O.C.G.A. § 44-14-610)

Security deeds: the Georgia mortgage

In Georgia a deed to secure debt is held to be an absolute conveyance, with the borrower’s right to have the property reconveyed when the debt is paid; it is not treated as a mortgage (§ 44-14-60). A paid loan leaves a title problem if the cancellation never reaches the record. Within 60 days after full payment, the lender must send the clerk a legally sufficient satisfaction or cancellation, and § 44-14-3(c) sets liquidated damages when that does not happen under the conditions it lists. Separately, title conveyed by a security deed reverts to the borrower seven years after the maturity of the debt as stated in the recorded conveyance, with other periods in some cases (O.C.G.A. § 44-14-80).

Judgment liens and dormancy

A Georgia judgment binds all of the defendant’s real and personal property from the date of the judgment, except as the Code provides (O.C.G.A. § 9-12-80). Against good-faith buyers and lenders without notice, though, a money judgment is not a lien until its execution is entered on the general execution docket (§ 9-12-81). A judgment becomes dormant if seven years pass without the required docket entries or public efforts to enforce it (§ 9-12-60). Whether an old judgment still matters is a legal question; ask a Georgia real estate attorney.

Mechanics’ and materialmen’s liens

The CFPB names contractors “who say they were not paid for work done on the home before you purchased it” as one source of title claims (CFPB). Georgia’s deadlines are short and printed on the lien itself:

  • A Georgia mechanic's or materialman's lien must be filed with the clerk of superior court within 90 days after the work is completed or materials furnished. O.C.G.A. § 44-14-361.1
  • The lien claimant must start a lien action within 365 days after filing the claim of lien. O.C.G.A. § 44-14-361.1
  • Georgia lien claims filed after March 31, 2009 must state on their face that they expire and are void 395 days after filing if no notice of commencement of a lien action is filed. O.C.G.A. § 44-14-367

Liens filed after March 31, 2009 must state on their face that they expire and are void 395 days after filing if no notice of commencement of a lien action is filed (O.C.G.A. § 44-14-367). If work was done on the property in the last few months, a new lien can still be filed after you go under contract.

Tax liens: county, state and federal

Except as § 48-2-56 provides, Georgia tax liens are superior to all other liens and are paid before any other debt, lien or claim (O.C.G.A. § 48-2-56). In Lumpkin County, real estate taxes are due December 1; unpaid taxes accrue a 5% penalty after 120 days and again every 120 days up to a cumulative 20%, and a tax fi.fa. can be recorded in the Clerk’s office once taxes are more than 90 days past due. If taxes stay unpaid, the property may be levied upon and ultimately sold (Lumpkin Tax Commissioner). The Georgia Department of Revenue calls a state tax lien a state tax execution and says it may hamper the transfer of property. The IRS defines a federal tax lien as the government’s legal claim against your property when you neglect or fail to pay a tax debt.

Association liens

Under Georgia’s Property Owners’ Association Act, lawful assessments are a lien on the lot that is superior to all other liens except those the statute lists, such as ad valorem taxes and a first-priority mortgage, and the lien lapses four years after the assessment first became due. Justia labels this text of § 44-3-232 effective until January 1, 2027, so this is the rule as of October 2026. Associations are common where roads are private: the county code requires a Class III subdivision with private roads to have covenants creating a mandatory homeowners association that assesses dues to maintain them (Lumpkin County Code, Sec. 26-62).

How to run a lien search

  1. Find the current owner’s name and the parcel on the county’s qPublic site (Lumpkin County).
  2. Search the GSCCCA lien index by owner name for each owner in the period you are searching. A Single-Use account gives one four-hour session for a one-time $5.00 fee plus $0.50 per printed page; a Limited-Use account searches the index and shows summaries without images, and GSCCCA’s page lists no price for it (GSCCCA accounts).
  3. Search the deed index, which covers all counties since at least January 1, 1999, for security deeds and their cancellations.
  4. For anything older, go to the Clerk’s office. GSCCCA warns that its historical indexes were re-created from document images and that the Clerk’s index is official wherever the two differ (GSCCCA terms).
  5. Ask the Tax Commissioner’s office about unpaid property taxes.

How liens are cleared at closing

A lien found in the search usually appears in the title commitment as a requirement to pay and release it before the policy issues, or as an exception if it stays; see title commitments explained. Closing payoffs are covered on our sister guide to Dahlonega closings. A lien the statutes say has expired may still need a recorded document before an insurer drops it; see curing title problems.
