A quitclaim deed is a document a person signs. A quiet title action is a lawsuit a court decides. The names sound alike and searchers mix them up, but they do different jobs: a deed passes whatever interest the signer holds, while a quiet title proceeding asks a judge to settle who owns the land. Georgia has two kinds of quiet title proceeding, and neither is a form you fill in.

What a quitclaim deed does
A quitclaim deed is a deed, and Georgia treats it like other deeds when it comes to recording. “Every deed conveying lands shall be recorded in the office of the clerk of the superior court of the county where the land is located” (O.C.G.A. § 44-2-1). Recording protects priority: “a prior unrecorded deed loses its priority over a subsequent recorded deed from the same vendor when the purchaser takes such deed without notice of the existence of the prior deed.” A deed to Georgia land signed outside Georgia “must be attested by two witnesses, one of whom may be” the notary or another listed official (O.C.G.A. § 44-2-21).
A quitclaim cannot hand over more than the signer holds. Family land shows why. The Georgia Heirs Property Law Center notes that “An heir can sell his or her interest in heirs property to any non-family or family member and does not need the consent of any other heir” (Georgia Heirs Property Law Center), but heirs property owners “Cannot sell or mortgage property without agreement of all heirs.” One cousin’s quitclaim moves one cousin’s share. Quitclaims from every heir can bring the title together; quitclaims from some of them cannot. See heirs property in Georgia.
Do you need a lawyer for a quitclaim deed in Georgia?
The Supreme Court of Georgia approved UPL Advisory Opinion 2003-2, agreeing “that only a licensed Georgia attorney may prepare or facilitate the execution of a deed of conveyance” (Supreme Court of Georgia). This guide does not supply deed forms. If you are thinking about signing or accepting a quitclaim deed, ask a Georgia real estate attorney how the opinion applies to your situation.
The two Georgia quiet title actions
Georgia’s Code has two separate proceedings, and many web pages swap their section numbers.
- Conventional quia timet, O.C.G.A. § 23-3-40. This proceeding lets a court cancel an instrument that “either casts a cloud over the complainant’s title or otherwise subjects him to future liability or present annoyance, and the cancellation of which is necessary to his perfect protection” (O.C.G.A. § 23-3-40). A forged deed in the chain is the classic example.
- In rem quiet title, O.C.G.A. § 23-3-60 and following. The purpose clause says it exists “so that there shall be no occasion for land in this state to be unmarketable because of any uncertainty as to the owner of every interest therein” (O.C.G.A. § 23-3-60). A qualifying claimant “may bring a proceeding in rem against all the world to establish his title to the land and to determine all adverse claims thereto” (O.C.G.A. § 23-3-61). The Code history of this part cites a 1966 act.
“Against all the world” is the key difference. A quitclaim binds only its signer. An in rem judgment speaks to everyone with a possible claim, including people who cannot be found, which is why it is the tool for titles that no stack of deeds can fix.
Tools between a deed and a lawsuit
Not every gap needs a court. Georgia gives several record tools, each with a defined job.
- Recorded affidavits. Affidavits about facts such as relationships, deaths, identity and possession “shall be notice of the facts therein recited” once recorded (O.C.G.A. § 44-2-20).
- A deed of assent. Title to estate property “does not pass to the heirs or beneficiaries until the personal representative assents,” and “Assent should be evidenced in writing as a deed of conveyance to real property” (O.C.G.A. § 53-8-15).
- Prescriptive title. Twenty years of qualifying possession, or seven under color of title, can confer title by prescription; turning that into a clean record title is one of the jobs the in rem action does. See 7 years or 20.
Which tool fits depends on what is wrong with the record, who is alive, who can be found and who will sign. That judgment belongs to a Georgia real estate attorney. Our page on curing title problems sets the options out in order, and Lumpkin County deed records shows where to pull the deeds an attorney will ask to see.
Why the mix-up matters
A buyer who is offered “a quitclaim from the other side of the family” should know it settles nothing beyond the signers’ own shares, and a title insurer reading the commitment will ask for whatever it needs to insure the whole title. A seller who hears “you need a quiet title” should know it is a court case with notice to claimants, not a form. Getting the vocabulary right is the first step to a realistic plan. If you are selling Lumpkin County land with a title question, Gold Peach Realty can help you organize the records before you meet your attorney.
