Land Next to the Chattahoochee National Forest: Boundaries and Access

The short answer

Land next to the Chattahoochee National Forest is common in Lumpkin County, where the county says 44% of its area lies in the forest. The title questions are the boundary line, anything built across it, and access: occupying or using forest land, including a private driveway, takes a Forest Service special-use authorization. A current survey tied to the record title is the main tool.

Land next to the Chattahoochee National Forest is common in Lumpkin County, which describes itself as 283 square miles, 44% of it within the forest (Lumpkin County). For a buyer, the forest is a neighbor with three title questions attached. Where exactly is the line? Is anything of yours, or anything you plan, on the wrong side of it? And does your access depend on crossing forest land? The answers come from a current survey tied to the record title and, where forest land is crossed, from a Forest Service authorization.

Who manages the forest land in Lumpkin County

Forest Service project records for Lumpkin County list the Blue Ridge Ranger District (USFS). The district office is at 2042 Highway 515 West, Blairsville, GA 30512, phone 706-745-6928, open Monday through Friday, 8:00 to 4:30, closed federal holidays (USFS). We found no Chattahoochee-Oconee web page explaining how the agency marks its boundaries or handles encroachments for neighbors, so questions about a specific line go to the district office.

The boundary line is a survey question

In title terms the forest line is a boundary like any other, and Georgia’s survey standards apply to it. Every surveyed parcel should be made conformable with its record title boundaries (Ga. Comp. R. and Regs. 180-7). The surveyor must check conformity with adjoining tracts and report overlaps and gores on every map, plat and report (Ga. Comp. R. and Regs. 180-7). When a survey cannot match record title, the surveyor must explain why; the listed reasons include possession lines, acquiescence, adverse possession, unrecorded deeds and vague deed descriptions (Ga. Comp. R. and Regs. 180-7).

The Forest Service describes its own land on the same grid as your deed. A 2019 Blue Ridge District permit in neighboring Union County, for example, located a private road access by tract, land lot, district and section (USFS). That makes it possible to compare your plat, your deed and the agency’s tract on the same terms. How to read those calls is in our legal description article.

Encroachments: building, clearing or driving on forest land

The Forest Service says occupying or using National Forest System land requires a special-use authorization, “a legal document such as a permit, term permit, lease, or easement,” granted “for a specific use of the land for a specific period of time” (USFS). If a shed, a fence, a cleared yard or a driveway sits over the line, ask whether an authorization covers it before you count it as part of what you are buying.

Title insurance follows the survey here. Under the 2021 ALTA Owner’s Policy, encroachments and boundary-line overlaps are covered only if an accurate and complete land title survey would have disclosed them (2021 ALTA Owner’s Policy). A problem at the forest line is exactly the kind of matter only a survey reveals. More on the survey exception is on surveys and boundaries.

Access across forest land

If the road or driveway to a tract crosses forest land, ask the seller for the special-use authorization that covers it, and read its terms: the holder, the use allowed and the period it runs. The 2019 Union County example above was a permit for a private road access of 0.01 acre, 30 feet long by 14.52 feet wide (USFS). Whether an authorization can pass to a new owner is a question for the Ranger District.

The 2021 ALTA Owner’s Policy lists no right of access to and from the land as a covered risk (2021 ALTA Owner’s Policy), and ALTA publishes an endorsement titled “Access and Entry” (17-06) (ALTA). What either does for a particular tract depends on the commitment’s exceptions, so ask the closing attorney you choose. Private ways over private land work differently; see easements and landlocked land.

What to ask for in a survey of land that borders the forest

  1. A boundary survey by a professional land surveyor licensed by the Georgia Professional Engineers and Land Surveyors Board (O.C.G.A. § 43-15-2).
  2. The land lot, district and section, so the plat lines up with the deed and the forest tract.
  3. Overlaps and gores with the adjoining forest tract, reported on the plat.
  4. Apparent encroachments in either direction and observed evidence of human burials or cemeteries, which the standards require plats to show (Ga. Comp. R. and Regs. 180-7).
  5. The location of the road or driveway against the line, and any recorded easement it uses.
  6. Streams and their buffers: 25 feet for warm-water streams and 50 feet for primary and secondary trout waters, per Lumpkin County Planning (Lumpkin County FAQ).
  7. The flood zone from FEMA’s current maps, which for Lumpkin County carry an effective date of April 4, 2018 (FEMA NFHL).

ALTA also publishes an endorsement titled “Same as Survey” (25-06) (ALTA); ask the closing attorney whether it is offered on your policy. A longer step-by-step version of this list is in our article on buying land next to the Chattahoochee National Forest.
